| Terms of Service Advertising/Promotion By purchasing, ordering, or having your image taken for creation of a player banner, you acknowledge that your image, banner or information may be used by YourKidsInAction LLC, your school, group or organization for promotional or advertising purposes. We will not directly sell or profit from using banner images in any way without written permission from player/parent prior to doing so except to show them as examples of our work to prospective customers. We keep a list of excluded players which we check before creating promotional literature. If you would like your player to be excluded from any advertisement or promotional use, please email us and we will add them to our list. Damage Waiver By ordering a banner, you acknowledge that your banner, if on display at any venue, my be subject to damage. Although we take great care in installing your banners at your venues using the very best materials for the application, because they are NOT displayed in secure locations and may also be exposed to severe weather conditions and possible random acts of vandalism, we assume no liability should any damage occur while your banners are on display. We can, however, replace your banner at "discounted pricing" should damage be sufficient enough that you would request us to do so. You may opt out of displaying your banner at your school or venue by checking the "NO HANG" option on your order form and you are also required to notify us via email that you do not want your banner to be hung. This must be done within 3 days after banner pictures are taken. Displaying Of Your Banner Not all banners will be displayed! Each sport predetermines which teams (I.E. Varsity, JV, Freshman), player levels (Seniors, Underclassmen, Players that Dress or Play Up a level,etc..) that will be displayed at their venue. Please check with your coach prior to ordering if you have any questions about whether or not your banner will be hung. NO REFUND will be given if you purchase a banner and it is not displayed regardless of reason. You may opt out of displaying your banner at your school or venue by checking the "NO HANG" option on your order form and you are also required to notify us via email that you do not want your banner to be hung. This must be done within 3 days after banner pictures are taken. NSF Check Fees Any check not honored by your bank for insufficient funds will incur an additional charge of $35 to cover fees assessed by our bank. Errors/Typos/Corrections By purchasing a banner, you acknowledge that errors can occur in our process. While we take great care in creating your banner, please understand that each banner we produce is unique and customized for each player. Occasionally we may make an error on producing your banner. We will correct your design and reprint it as soon as we are able to do so but make no guarantee to a specific time frame for this to be done by. Please know that we understand the inconvenience and will remedy the problem as soon as possible. Submitted Images For Banners By submitting your image with your banner order, you acknowledge that you are the photographer and/or that you have sole permission to use the submitted image for the creation of your banner. By acknowledging this, you agree to bear all responsibility for our using your submitted images for the purpose of creating your player banner and agree to hold harmless YourKidsInAction, LLC or any of it's owners and bear full responsibility for any litigation brought against YourKidsInAction, LLC or it's owners. If you are not the original photographer of the images you wish to submit, nor have the written authorization to use said images by the copyright holder, you are hereby directed and forbidden from uploading said images for our use in creating your banner. You acknowledge by submitting your image that you have reviewed and agree to these terms. By submitting any images to us for the creation of a player banner, you acknowledge that the school or club has the final say and approval as to pose, content, copy and display.
